FolderZoom Terms of Use

These terms are an agreement between you and FolderZoom Team ("we", "us") about FolderZoom for Mac ("the app"). By installing or using the app you accept them.

1. The license

The app is licensed to you, not sold. If you obtained it from the Mac App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies as well, and the App Store's usage rules decide on how many Macs and for which Apple Accounts you may use it. Where these terms and Apple's agreement differ, Apple's agreement takes precedence for the matters it covers. We, not Apple, are responsible for the app and its content.

You may not copy the app except as the App Store allows, resell or sublicense it, remove notices from it, or reverse engineer it except where the law gives you that right regardless.

2. Free use and FolderZoom Pro

The app can be used free of charge. The free edition shows an offer for FolderZoom Pro and is limited to one window.

FolderZoom Pro removes that offer, allows several windows, sorts by two columns and filters lists from their column headers, and may include further features described on the App Store page at the time you buy it. It is available as:

  • FolderZoom Pro, yearly: an auto-renewing subscription of one year. The price is the one the App Store shows you, in your currency, before you confirm the purchase.

How the subscription works

  • Payment is charged to your Apple Account when you confirm the purchase.
  • The subscription renews automatically for another year unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before that date, at the price shown to you.
  • You manage and cancel the subscription in your Apple Account settings (System Settings › your name › Media & Purchases › Subscriptions, or the App Store › your name › Subscriptions). Deleting the app does not cancel it.
  • When a subscription ends, the app goes back to the free edition. Nothing of yours is removed.
  • If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
  • Purchases are handled by Apple. Refunds are decided by Apple: https://reportaproblem.apple.com
  • You can restore a purchase on another Mac that uses the same Apple Account with Settings › FolderZoom Pro › Restore Purchases.

We may change prices for new purchases. For a running subscription Apple tells you about a price increase in advance and, where the law requires it, asks for your consent.

3. Your files are your responsibility

FolderZoom moves, copies, renames, compresses, extracts and deletes files and folders on your instruction, on your Mac and on the disks, servers and cloud folders you connect. It is built to avoid losing data: it asks before replacing, moves replaced and deleted items to the Trash, checks a copy before removing the original of a move between disks, and can undo its operations. No software can rule out loss, for example through failing disks, interrupted connections, full disks, power loss, other software, or an instruction that did something other than you meant.

You alone decide what the app does to your files, and you use it at your own risk. You are responsible for keeping current backups of everything you cannot afford to lose, and for checking the result of an operation before you delete the originals or empty the Trash. We do not store, see or back up your files, and we cannot restore them.

4. No warranty

TO THE FULLEST EXTENT THE LAW ALLOWS, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP IS FREE OF ERRORS, THAT IT WILL WORK WITHOUT INTERRUPTION, THAT IT WILL WORK WITH EVERY DISK, FILE SYSTEM, SERVER OR VERSION OF macOS, OR THAT FILES AND DATA WILL NOT BE LOST, DAMAGED OR CHANGED. No advice or information from us, in the app, on the website or from support, creates a warranty. Some places do not allow these exclusions; there, the warranties the law requires apply, for the shortest period the law allows.

5. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY LOSS OF, DAMAGE TO OR CORRUPTION OF FILES, FOLDERS OR DATA, FOR THE COST OF RECOVERING OR RECREATING THEM, FOR LOST PROFITS, REVENUE, BUSINESS OR GOODWILL, FOR BUSINESS INTERRUPTION, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS, WHATEVER THE LEGAL THEORY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR ANY OTHER), AND EVEN IF WE WERE TOLD THAT SUCH DAMAGE WAS POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AND FIFTY U.S. DOLLARS (US$50). These limits apply even if a remedy fails of its essential purpose, and they are part of the basis on which the app is offered, free of charge or at its price. Nothing in these terms limits liability that the law does not allow to be limited, such as for intent, gross negligence or personal injury.

6. Indemnity

To the extent the law allows, you agree to defend us against, and to compensate us for, claims by others, and the resulting damages, costs and reasonable legal fees, that arise from your use of the app in breach of these terms or of the law, or from what you do with files that are not yours to copy, move, change or delete. This does not apply where the law of the place you live in forbids it for consumers.

7. Open-source components

The app includes open-source software under its own licenses, shown in the app under Help › Acknowledgements and at https://folderzoom.com/acknowledgements.

8. Privacy

The app does not collect personal data. See the Privacy Policy: https://folderzoom.com/privacy.

9. Changes and ending

We may update these terms; the date at the top changes when we do, and continued use of the app means you accept the new version. The license ends if you break these terms. You can end it at any time by deleting the app (and canceling any subscription as described above).

10. Law and courts

These terms, and any dispute or claim related to them or to the app, including a claim under the indemnity above, are governed by the laws of the State of Illinois, United States, without its conflict-of-law rules. The state and federal courts located in Chicago, Cook County, Illinois, have exclusive jurisdiction, and you and we accept the jurisdiction of those courts and that they are a convenient place. If you are a consumer, the mandatory consumer protection of the place you live in, and your right to go to its courts where the law gives you that right, stay in force.

If a part of these terms cannot be enforced, the rest stays in force, and that part is applied as far as the law allows.
